3.4 In addition to the rates charged for Electric Utility Service, PEC may make and enforce <br />reasonable charges, rules, and regulations for service rendered in the conduct of its <br />business. Nothing in this Ordinance should be construed to relieve any Customer of its <br />obligations to PEC or to abridge its rights of membership in PEC. PEC agrees to apply its <br />PEC Service Regulations in a fair and uniform manner when providing Electric Utility <br />Service to its Customers who reside within the limits of the City. PEC shall not deny <br />Electric Utility Services, or otherwise discriminate against applicants for service or <br />Customers, on the basis of race color, religion, national origin, sex, or sexual orientation. <br />Subject to compliance with PEC's Service Regulations, Electric Utility Services shall be <br />provided to Customers within the City for areas which PEC holds a valid Certificate of <br />Convenience and Necessity issued by the PUCT. <br />3.5 PEC shall maintain its System in good order and condition, consistent with its customary <br />business practices and in accordance with all applicable laws, codes and regulations. The <br />City recognizes and agrees that PEC shall retain full title in, and right to, its System and <br />all property located in the City, whether or not the same is incorporated in or affixed to <br />real estate. <br />3.6 The City, at any time, may make reasonable inquiries pertaining to this Ordinance, and <br />PEC shall respond promptly to such inquiries. <br />3.7 PEC shall keep the City informed concerning PEC's conservation programs. Upon <br />request, PEC shall deliver to the City a copy of the energy efficiency plan, if any, required <br />to be filed by PEC with the PUCT pursuant to the PUCT rules and regulations. <br />SECTION 4. Use of Streets and Easements <br />4.1 In addition to the other rights granted in this Franchise, PEC is hereby authorized, <br />licensed and empowered to do any and all things necessary and proper to be done and <br />performed in executing the powers and using the privileges granted and described by <br />this Franchise. Provided, however that: (a) such activities shall cause the least <br />interference reasonably possible with existing water pipes, sewer, electric power lines, <br />telephone lines, and cable television lines and any other authorized installations; and (b) <br />that all work done in the Public Ways by PEC shall be done with diligence; and (c) such <br />use complies with all City ordinances, federal and state laws, rules, and regulations, and <br />Charter provisions of the City now in force or that may hereafter be passed and <br />adopted. <br />4.2 By the grant of authority described in Section 4.1, it is not the intention of either the <br />City or PEC to create any liability, right or claim for the benefit of third parties, and this <br />Franchise is intended and shall be construed for the sole benefit of the City and PEC. <br />4.3 City will permit PEC to attach new or maintain its current attachments on City's existing <br />facilities on condition that PEC executes the City's Pole Rental Agreement and maintains <br />M. <br />
