ASSIGNMENT OF INTERLOCAL COOPERATION CONTRACT <br />This Assignment ( "Assignment ") of the Community Development Partnership Program Letter <br />Agreements between the City of San Marcos ( "City ") and the Lower Colorado River Authority <br />( "LCRA "), da ed Ju 19, 2004 and November 30, 2002 ( "Agreements ") is entered into as of this <br />(C day of 2012. <br />WHEREAS, the City and Texas State University -San Marcos have participated in the <br />development and operation of the Advanced Law Enforcement Rapid Response Training Center <br />(the "ALERRT Center "), a law enforcement training facility; <br />WHEREAS, LCRA and the City entered in the Agreements for LCRA grant funding for the <br />acquisition of equipment, facilities and other personal property (the "Property ") related to the <br />operation of the ALERRT Center, said Agreements being attached hereto; <br />WHEREAS, the University has assumed primary responsibility for management of the ALERRT <br />Center and its activities and will continue to utilize the ALERRT Center in its existing manner as <br />a law enforcement training facility; <br />WHEREAS, consistent with the University's primary responsibility for management of the <br />ALERRT Center, the City desires to transfer ownership and care of the Property funded by <br />LCRA grants at the ALERRT Center to the University; and <br />NOW THEREFORE, in consideration of the mutual agreements contained herein and other <br />good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, <br />the Parties agree as follows: <br />The City hereby transfers, conveys and assigns all of the City's right, title and interest <br />in and to the Agreements to the University, and the University does hereby accept <br />this assignment and agrees to assume and perform all obligations and covenants of <br />the City under and with respect to the Agreements. <br />2. This Assignment shall become effective upon transfer from the City to the University <br />of the ALERRT Center Property funded under the Agreements. <br />3. The City Manager of the City and a duly authorized representative of the University <br />are authorized to execute such legal instruments as are reasonably required or <br />necessary to effect a conveyance of all right, title and interest in and to the Property <br />as provided herein. <br />
