ORDINANCE 2006- 59 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING DIVISION 18, SECTION 2.366, ANIMAL SHELTER ADVISORY COMMITTEE, OF THE CITY OF SAN MARCOS CODE OF ORDINANCES RECITALS: 1. The City of San Marcos has entered into a long term interlocal agreement with Hays County and the City of Kyle for the provision of animal care and sheltering of animals picked up by those two entities. As part of the interlocal agreement, the County and Kyle are providing substantial financial assistance to the City for the purpose of enlarging the present animal shelter. 2. The Animal Shelter Advisory Committee provides advice to staff regarding the shelter operation and welfare of animals. 3. Because the City animal shelter will be housing a substantial number of animals from the County and Kyle, those two entities should be represented on the Advisory Committee. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Chapter 2, Section 18, Animal Shelter Advisory Committee is amended as follows (underlinina indicates added text, strikethrough indicates deleted text): Sec. 2.366. Established; appointment; terms. The animal shelter advisory committee is established, in accordance with state law. The committee will consist of one licensed veterinarian, one city official, one person whose duties include the daily operation of an animal shelter, one representative from an animal welfare organization, aAG one resident of the city or the city's extraterritorial jurisdiction, one person appointed bv the City of Kvle~ and one person appointed bv Havs County. With the exception of the persons appointed bv the County and Kvle~ the committee will be appointed by the city council for staggered terms of three years. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed.
