<br />I <br /> <br />I <br /> <br />I <br /> <br />DEVELOPMENT INCENTIVE AGREEMENT BETWEEN THE <br />CITY OF SAN MARCOS AND GRANDE COMMUNICATIONS, INC., FOR <br />COMMERCIAL DEVELOPMENT PROJECT <br /> <br />This development incentive agreement (this "Agreement") is entered into between the City of <br />San Marcos, Texas (the "City"), a Texas municipal corporation, and Grande Communications <br />Networks, Inc. ("Grande"), a Delaware Corporation duly authorized to perform business in the State <br />of Texas. <br /> <br />PART 1. GENERAL PROVISIONS <br /> <br />Section 1.01. This Agreement is authorized and governed by the Economic Development <br />Incentives Policy (the "Policy") adopted by the City Council by Resolution on February 23, 2004, <br />and under Chapter 380 of the Texas Local Government Code. <br />Section 1.02. Grande Communications is proposing to renovate 7,000 square feet of their <br />headquarter facility (the "Property") with the value of these improvements to be approximately <br />$140,000. The facility is located at 401 Carlson Circle, in San Marcos, Hays County, Texas. The <br />Property meets the eligibility criteria for development incentives under the Policy. Upon completion <br />ofthe renovation, Grande anticipates that it will add between 40 to 60 employees to their San Marcos <br />payroll. <br /> <br />Section 1.03. Grande agrees to ensure that all ofthe improvements described in Part 2 below <br />will conform to all applicable City ordinances and regulations, including but not limited to the City's <br />Master Plan, and Chapter 5-Buildings and Building Regulations, ofthe San Marcos City Code, and <br />the applicable provisions of the City Land Development Code. <br /> <br />PART 2. PROPERTY IMPROVEMENTS <br /> <br />Section 2.01. Grande intends to renovate approximately 7,000 square feet of their existing <br />property (the "Building") at a cost of approximately $140,000. <br />Section 2.02. Grande will ensure that the construction ofthe Building and related facilities <br />is completed by July 1, 2007. <br />Section 2.03. Grande will endeavor to add 40-60 new permanent positions after the <br />renovation of the Building. <br />Section 2.04.
