ORDINANCE NO. 2006 -~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE ABANDONMENT OF AN ALLEY LOCATED ADJACENT BETWEEN THE 1500 BLOCKS OF BROWN STREET AND PROSPECT STREET; APPROVING THE CONVEY ANCE OF THIS ALLEY TO GLORIA AND ARTHUR AMEY; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. On July 20, 2006, Gloria and Arthur Arney submitted an application to abandon an alley approximately 15 feet wide by 234 feet long between the 1500 Blocks of Brown Street and Prospect Street, as depicted on the attached Exhibit A. 2. The application was accompanied by the written consent to the abandonment by all owners of property adj acent to the alley, and by the agreement of the owners of the property on the other side of the alley, Eva and Welton Hamilton, for the applicants to take title to the entire width of the alley if abandonment of the alley is approved. 3. On September 12,2006, the City Planning and Zoning Commission conducted a public hearing on the request, and voted unanimously to recommend approval of the request. 4. The City Council conducted a public hearing regarding this abandonment on November 6., 2006 ,2006. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The abandonment of the alley approximately 15 feet wide by 234 feet long between the 1500 Blocks of Brown Street and Prospect Street, as depicted on the attached Exhibit A A, is approved. SECTION 2. The City Manager, Dan O'Leary, is authorized to execute Quitclaim Deeds without cash consideration to convey the alley to Gloria and Arthur Arney. SECTION 3. This Ordinance will take effect 10 days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
