<br />ORDINANCE NO. 2006-~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM INDUSTRIAL TO COMMERCIAL <br />FOR A 3.1 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT <br />2030 IH-35 SOUTH; AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING THIS TRACT FROM "HI" HEAVY <br />INDUSTRIAL DISTRICT TO "GC" GENERAL COMMERCIAL <br />DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On September 26, 2006, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the Future Land Use Map of the San <br />Marcos Horizons City Master Plan from Industrial to Commercial, and a concurrent request to <br />change the zoning from "HI" Heavy Industrial District to "GC" General Commercial District, for <br />a 3.1 acre, more or less, tract of land located at 2030 IH-35 South. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on September 26, 2006, and recommended that the <br />requests be approved by the City Council. <br /> <br />3. The City Council held a public hearing on November 21,2006 regarding the <br />requests. <br /> <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from Industrial <br />to Commercial: <br /> <br />Street address: 2030 IH-35 South <br /> <br />Size: 3.1 acres, more or less <br />
