<br />I <br /> <br />RESOLUTION NO. 2007-7 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE PURCHASE OF TWO <br />PARCELS OF LAND TOTALING 1.288 ACRES, MORE OR LESS, FOR <br />A UTILITY EASEMENT IN CONNECTION WITH THE POSEY ROAD <br />WATER LINE PROJECT; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE ALL NECESSARY DOCUMENTS IN CONNECTION WITH <br />THIS PURCHASE; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br /> <br />1. The City of San Marcos is going to construct a water transmission main to be <br />known as the Posey Road Watermain Project (the "Project") to replace a deteriorated <br />line that was purchased by the City from Elim Water Supply. This project is being <br />constructed to serve the property in the area and to connect with the existing line that <br />passes under 1-35. <br /> <br />2. The Project requires the City to obtain utility easements, rights-of-way or <br />other interests in certain real property in the vicinity of the Project. <br /> <br />3. The City has reached an agreement to purchase 1.228 acres of land, in <br />two parcels, belonging to the same party, at a cost of $ 60,656.25. <br /> <br />I BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The purchase of an easement, as more fully described on the easement <br />attached to this Resolution as Exhibit 1, is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute all necessary <br />documents in connection with the purchase of the above described easements on <br />behalf of the City. <br /> <br />PART 3.
