AMENDMENT TO LEASE AGREEMENT <br />The following shall serve as an Amendment, dated August 1, 2012, for reference purposes <br />only, to that certain Lease Agreement by and between Sendero Plaza Hwy LLC (Landlord) and <br />City of San Marcos, WIC Program (Tenant), and <br />WHEREAS, Landlord and Tenant entered into a Shopping Center Lease for approximately <br />2700 square feet of space in the Sendero Plaza Shopping Center, located at 1405 & 1409 <br />Highway 123 Bypass in the City of Seguin, Texas; and <br />WHEREAS, the parties hereto have agreed that the Lease shall be amended and modified; <br />NOW, THEREFORE, in consideration of ONE and NO /100 DOLLARS ($1.00) and other good <br />and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the <br />undersigned do hereby agree to the Amendment to Lease Agreement as follows: <br />1. TERM: Five (4) Years <br />(Beginning October 1, 2012; Maturing September 30, 2016) <br />MINIMUM GUARANTEED RENTAL: <br />Year 1: $2,812.50 per month <br />Year 2 $2,925.00 per month <br />Year 3 $2,981.25 per month <br />Year 4 $3,037.50 per month <br />3. Common Area Maintenance, Real Estate Taxes and Insurance: Tenant shall <br />pay its proportionate share (26.47 %) of Landlord's expenses for Common Area <br />Maintenance, Real Estate Taxes and Insurance, subject to annual adjustment <br />thereof, however Common Area expenses, not including Taxes and Insurance, <br />shall not exceed three percent (3 %) per annum increase. <br />If there are any conflicts between the terms and provisions of the Lease and the Amendment, <br />the terms and provisions of the Amendment shall prevail. <br />All other terms and provisions of the Lease shall remain in full force and effect. <br />AGREED AND ACCEPTED: <br />TENANT: <br />City of San Marcos WIC Program <br />By: <br />James R. u e, P.E. -City Manager _ <br />Date <br />D <br />Date <br />LANDLORD: <br />Sendero PI Hwy LLC <br />t <br />By: <br />/Z1- <br />
