RESOLUTION NO. 2012 - 98R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE RELEASE OF AN EASEMENT <br />FOR PUBLIC RIGHT -OF -WAY, UTILITY AND DRAINAGE PURPOSES <br />SUBJECT TO THE DEDICATION OF A SUBSTITUTE EASEMENT BY <br />PLAT OF LOTS 4, 5 AND 6 OF THE BLANCO SHOALS SUBDIVISION <br />LOCATED NORTH OF EAST RIVER RIDGE PARKWAY AT <br />INTERSTATE HIGHWAY 35; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THIS RELEASE ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached Release of Easement is approved. <br />PART 2. The City Manager is authorized to execute the Release of Easement on <br />behalf of the City, subject to the limitations in Part 3. <br />PART 3. The Release of Easement shall be effective and may be recorded only upon <br />the recording of the final plat of Lots 4, 5 and 6 of the Blanco Shoals Subdivision dedicating a <br />substitute easement for public right -of -way, utility and drainage purposes acceptable to the City. <br />PART 4.
