<br />Texas City, Galveston County, TX 77590.
<br />Grantee: City of San Marcos, Texas, 630 E. Hopkins Street, San Marcos, Hays County, TX 78666
<br />Consideration: Ten Dollars ($10.00) and other valuable consideration.
<br />Easement Area: A 2.552 acre tract of land out of the J.M. Veramendi Survey No.2, Abstract No.
<br />17, Hays County, Texas, being a part of a remainder portion of a called 189.6 acre tract of land
<br />conveyed to C.C. Holt in Volume 184, Page 106, Deed Records for Hays County, Texas, and being
<br />more particularly described by metes and bounds in the attached Exhibit A.
<br />Reservations From and Exceptions to Conveyance and Warranty: The following easements as
<br />recorded in the Hays County Deed Records: From Ella R. Woods to Texas Power and Light
<br />Company, recorded in Volume 94, Page 471; From Ella Rivas Cox et al. to Lower Colorado River
<br />Authority, recorded in Volume 149, Page 334; and from Mary Woods King et al. to Southwestern
<br />Bell Telephone Company, recorded in Volume 124, Page 275.
<br />Grantor, for the consideration, grants, sells and conveys to the Grantee an easement for public right -
<br />of -way, utility (including, without limitation, water, wastewater, natural gas, cable, electric,
<br />communications or any other character of public utility) and drainage purposes within, across,
<br />through and over the Easement Area, together with the right to construct, place, install, reconstruct,
<br />replace, alter, excavate, fill, operate and maintain street, sidewalk, roadway, bridge, trail, utility and
<br />drainage improvements, and all associated equipment, facilities and appurtenances upon, over,
<br />across, through and under the Easement Area, and the free and uninterrupted rights of the Grantee
<br />and the public for access and thoroughfare within, across, through and over the Easement Area at
<br />all times, to have and to hold it to Grantee and Grantee's successors or assigns forever. Grantor
<br />binds Grantor and Grantor's heirs, executors, administrators, successors and assigns to warrant
<br />and forever defend this easement to Grantee and Grantee's successors and assigns against every
<br />person whomever lawfully claiming or to claim the same or any part thereof, except as to the
<br />reservations from and exceptions to conveyance and warranty.
