RESOLUTION NO. 2012 - 99R <br />A RESOLUTION BY THE CITY OF SAN MARCOS, TEXAS, <br />SUPPORTING CAPITAL AREA RURAL TRANSPORTATION <br />SYSTEM'S ( "CARTS ") CREATION OF A COMBINED URBAN - <br />RURAL TRANSIT DISTRICT IN ACCORDANCE WITH CHAPTER <br />458 OF THE TEXAS TRANSPORTATION CODE; CONFIRMING <br />THE CITY'S PARTICIPATION IN THE NEW COMBINED URBAN - <br />RURAL TRANSIT DISTRICT FOR FISCAL YEARS 2012 — 2015; <br />AUTHORIZING THE MAYOR TO EXECUTE ANY DOCUMENTS <br />REQUIRED TO EVIDENCE THE CITY'S SUPPORT OF CARTS' <br />CREATION OF A COMBINED RURAL -URBAN TRANSIT DISTRICT <br />AND THE CITY'S PARTICIPATION IN SUCH DISTRICT; AND <br />PROVIDING FOR AN EFFECTIVE DATE. <br />RECITALS: <br />1. The 2010 U.S. Census changes in urbanized area boundaries has <br />designated the San Marcos area as a new "small urban area "; and <br />2. The boundaries of the new "small urban area" include the City of San <br />Marcos, the City of Martindale, and unincorporated portions of Hays, Guadalupe and <br />Caldwell Counties; and <br />3. Pursuant to the provisions of CHAPTER 458 OF THE TEXAS <br />TRANSPORTATION CODE, new small urban areas must create an urban transit district in <br />order to receive state public transit funding; and <br />4. On May 24, 2012 a public transit conference was held at which the <br />conferees set a public hearing date of June 21, 2012, to receive public input regarding the <br />merits of creating an urban transit district; and <br />5. On June 21, 2012, after notice to all political subdivisions that are <br />included within the new urbanized area, a public transit conference was held at which the <br />conferees received input from members of the public regarding the merits of creating an <br />urbanized transit district, and at which the conferees determined that the creation of an <br />urban transit district should be further considered at a future urban transit workshop; and <br />6. On July 16, 2012, an urban transit district workshop was held at which the <br />conferees and other elected officials considered the merits of creating a new "urban <br />transit district" or combining a new "urban transit district" with the existing Capital Area <br />Rural Transportation System rural transit district, or take no action at all; and <br />7. On July 16, 2012, the conferees represented at the urban transit district <br />workshop determined that the creation of a combined urban -rural transit district by <br />Capital Area Rural Transportation System is in the best interest of preserving and <br />
