<br />ORDINANCE NO. 2007- 4 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND <br />USE MAP OF THE MASTER PLAN OF THE CITY, FROM <br />PUBLIC TO COMMERCIAL FOR A 2.436 ACRE, MORE OR <br />LESS, TRACT OF PROPERTY LOCATED AT 400 UHLAND <br />ROAD; AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY BY REZONING THIS TRACT FROM "P" PUBLIC AND <br />INSTITUIONAL DISTRICT TO "NC" NEIGHBORHOOD <br />COMMERCIAL DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECIT ALS: <br /> <br />1. On November 14, 2006" the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the Future Land Use Map of the San <br />Marcos Horizons City Master Plan from Public to Commercial, and a concurrent request to <br />change the zoning from "P" Public and Institutional to "NC" Neighborhood Commercial District, <br />for a 2.436 acre, more or less, tract of land located at 400 Uhland Road.. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on November 14, 2006, and recommended that the <br />requests be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on January 8., 2007 <br />requests. <br /> <br />regarding the <br /> <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from Public to <br />Commercial: <br /> <br />Street address: 400 Uhland Road <br /> <br />Size: 2.436 acres, more or less <br />
