The applicant states it was his intention for that setback to apply only to the front <br />yard, and for the side setbacks to be ten feet. The applicant wrote the Covenants, Conditions and <br />Restrictions for the subdivision to state side building setbacks shall be 10 feet. <br />Planning Department Analysis: <br />Because the PDD development standards do not specify which building setback shall be 20 feet, it <br />could be assumed to apply to front, side, and rear. The plat states that the front building setback <br />for these lots is 20 feet. However, there is no reference on the plat to being subject to a PDD. As <br />property owners and surveyors have no legal notice on the plat, two homes have been built in the <br />subdivision with 10 foot side setbacks. <br />Page 1 of 2
