I I I (b) Extension. A Site Preparation Permit may be extended for a period not to exceed an additional 90 days by the responsible official, within which development authorized by the permit on the property subject to the permit must be commenced. The date for issuance of a construction permit or commencement of construction of a structure may be extended by the responsible official for a period not to exceed one year. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City. The changes to the Land Development Code made in this Ordinance apply only to a project commenced on or after the effective date of S.B. No. 574, Acts of the 79th Texas Legislature, Regular Session, 2005. The prior version of the Land Development Code is preserved in effect to apply to all projects commenced before that effective date. PASSED AND APPROVED on first reading September 20, 2005.
