<br />I <br /> <br />ORDINANCE 2007 - 12 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS AMENDING THE TRAFFIC <br />REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br />SAN MARCOS CITY CODE BY AMENDING THE SPEED <br />LIMIT OF ALGARITA STREET AND CHAPARRAL ROAD; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Pursuant to Sections 82.003 and 82.066 of the City Code, on the basis <br />of an engineering and traffic investigation finding that the current speed limit is unsafe, the <br />traffic register maintained under Section 82.067 of the City Code is amended by adding the <br />following speed limit: <br /> <br />Algarita Street, in its entire length, both directions, 25 m.p.h. <br />Chaparral Road, in its entire length, both directions, 25 m.p.h. <br /> <br />I <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code. <br /> <br />SECTION 5. This ordinance shall be in effect ten days from and after its passage, <br />and the City Clerk will publish notice of its adoption in a newspaper of general circulation in <br />the City. <br /> <br />PASSED AND APPROVED on first reading January 18,2007 <br /> <br />PASSED AND APPROVED on second reading February 6, 2007 <br /> <br />I <br />
