PROFESSIONAL SERVICES AGREEMENT <br />This Agreement is effective this the 18th day of September, 2012, between the City of <br />San Marcos, Texas, (the "City "), 630 East Hopkins, San Marcos, Texas 78666 and John Gleason, <br />LLC (the "Consultant "), 406 Long Bow Lane, Austin, Texas 78704, will provide professional <br />services to develop a Water Quality Protection Plan (the "Services ") which will assist the City in <br />meeting the requirements of the Habitat Conservation Plan ( "HCP "). <br />The City and the Consultant agree as follows: <br />ARTICLE 1 <br />CONSULTANT'S SERVICES AND RESPONSIBILITIES <br />1.0 STANDARDS OF PERFORMANCE <br />1.0.1 The Consultant will be responsible for the Services included in this Agreement. These <br />Services are in addition to, and will be integrated with, the work performed by the Consultant <br />under separate Agreement dated August 3, 2012 for the Water Quality Protection Baseline Plan <br />(the "Baseline Plan "). These Services are part of the City and Texas State University at San <br />Marcos' ( "TxSt ") implementation of Section 5.7.6 of the HCP entitled, Impervious Cover/Water <br />Quality Protection. The Services generally include: <br />a) The preparation of a Water Quality Protection Plan (WQPP) for the benefit of the <br />City and TxSt as described in Section 1.1, below. The geographic area to be <br />considered in the WQPP includes the Upper San Marcos River watershed within the <br />City extending to the limits of the City's Extra - Territorial Jurisdiction (ETJ). <br />b) Providing recommendations for and modifications to the City's ordinance (Chapter 5 <br />— Environmental Regulations), Low Impact Development ( "LID") and Best <br />Management Practices ( "BMP ") Manual and the Stormwater Technical Manual to <br />ensure that the City's water quality regulations and criteria align with the objectives <br />of the HCP as further detailed in Section 1.2, below. <br />c) Providing development review services upon request, as described in Section 1.3. <br />The Consultant will consider potential ordinance and Technical Manual modifications <br />as well as the requirements of the HCP in providing this service. <br />1.0.2 The Consultant's Basic Services consist of the services described in Sections 1.0 through <br />1.3 and will include the following subcontractors to the Consultant: <br />(1) Espey Consultants, Inc. dba RPS Espey - Civil Engineering and Geographic <br />Information Systems <br />(2) Meadows Center for Water and the Environment — Watershed Modeling <br />Gleason WQPP 9/12 <br />
