10. <br />Regular Meeting April 28, 2003 Page 6 <br /> <br />ABSTAIN: None. <br /> <br />On roll call for approval of the Ordinance on first reading the following <br />vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Habingreither, Taylor and Mayhew. <br /> <br />NAY: <br /> <br />Mihalkanin and Montoya. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ADMINISTRATION OF THE CITY CODE TO ADD A NEW <br />SECTION 2.045 ESTABLISHING RULES OF DECORUM FOR CITY COUNCIL <br />MEETINGS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mr. Taylor moved for approval of the Ordinance on the first reading and <br />Ms. Narvaiz seconded the motion. Mr. Mark Taylor stated Council adopted a <br />Resolution in 1998 for the Mayor to establish the Rules of Decorum for <br />City Council Meetings. He stated the Council wants the citizens who <br />attend the meeting to be aware of the decorum in the Chambers. He stated <br />he added several items so the Council can delete the items they do not <br />agree with. Mr. Mayhew stated he does not feel signs have been a big <br />issue. Mr. Mihalkanin agreed under Rules of Decorum subtitle ~5 could be <br />deleted. Mr. Taylor stated signs do not bother him, but they can be a <br />distraction. Mayor Habingreither stated signs can block the view of other <br />citizens who attend the meetings. Mr. Mayhew stated he feels applause is <br />appropriate at times. He stated he feels the purpose of the Ordinance is <br />to address when people are unruly and cause problems. He feels if someone <br />is causing a distraction, a Police Officer shouId remove them. Mayor <br />Habingreither stated he feels if the Rules of Decorum are in place, and <br />the definitions are published and made available for citizens, this will <br />help the attendees expectations. He stated he feels the Rules of Decorum <br />should also be included in the upcoming Council Orientation. Mr. <br />Mihalkanin moved to amend Section 2.045(f) (4) to delete applause and (5) <br />delete Display of signs or banners, and Mr. Montoya seconded the motion, <br />which passed unanimously. Mayor Habingreither inquired what would happen <br />if no Police Officer was in attendance at the meeting. Mr. O'Leary stated <br />a Police Officer is not always in attendance, but if the Council wants a <br />Police Officer present, they would need to provide funding to pay for the <br />Officer. He stated typically there is a Police Officer attending the <br />meetings.
