ORDINANCE NO. 2012-44 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A .23 ACRE, MORE OR <br />LESS, TRACT OF LAND, BEING LOT 1, BLOCK 18 OF THE <br />ORIGINAL TOWN OF SAN MARCOS, LOCATED AT 302 WEST <br />SAN ANTONIO STREET FROM "SC -CS" SMARTCODE <br />DISTRICT -CIVIC SPACE TO "SC45" SMARTCODE DISTRICT - <br />TRANSECT 5 (URBAN CENTER); AND INCLUDING <br />PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. On August 14, 2012, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to rezone a .23 acre, more or less, tract of land, being <br />Lot 1, Block 18 of the Original Town of San Marcos, located at 302 West San Antonio Street <br />from "SC -CS" SmartCode District -Civic Space to "SC -T5" SmartCode District - Transect 5 <br />(Urban Center). <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the request on August 14, 2012, and recommended that the <br />rezoning request be approved by the City Council of the City. <br />3. The City Council held a public hearing on September 18, 2012 regarding the rezoning <br />request. <br />4. All applicable requirements of the San Marcos SmartCode and the City's Land <br />Development Code pertaining to SmartCode Zoning Map amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the following tract of real property from <br />"SC -CS" SmartCode District -Civic Space to "SC -T5" SmartCode District - Transect 5 (Urban <br />Center); <br />Street address: 302 West San Antonio Street. <br />Size: .23 acres, more or less. <br />Legal description: Lot 1, Block 18, Original Town of San Marcos, as described in <br />
