ADDITIONAL COVENANTS AND AGREEMENTS. <br /> <br />I <br /> <br />The followmg additional covenants and agreements shall be Incorporated Into this <br /> <br />agreement <br /> <br />a Sellers and Utility agree to maintain In full force and effect, up to the date of <br /> <br />closing, at Sellers' expense, all Insurance poliCies presently in effect upon the property <br /> <br />of Utility. Insofar as they relate to the property to be sold and transferred to the CIty <br />b City shall have the right and Sellers shall afford the City and all agents and <br />delegates of City and representatives of the TCEO or parties to any TCEQ hearing <br />concerning thiS agreement the opportunity to make such Inspections of Sellers and/or <br />Utility's books and records and properties as such persons or entitles shall deem <br />necessary In order to determine whether the representation I and warranties made <br /> <br />herein are true and correct and whether such transaction IS In the public Interest as <br /> <br />defined by the Texas Utilities Code <br />c All of the terms, representatIons, and covenants set forth In this agreement <br /> <br />are continuing terms representations and warranties and shall survIve the clOSing ThiS <br /> <br />agreement shall brnd and Inure to the benefit of the Sellers and the City and their <br /> <br />respective heirs. executors administrators successors and assigns <br /> <br /> <br />d City shall be obligated to operate the utility system In a prudent. workmanlike <br /> <br /> <br />manner and m compliance With all health and safety regulation of the TCEO. the EPA. <br /> <br /> <br />and the City of San Marcos as "regulatory authOrity" under Chapter 13, of the Code <br /> <br /> <br />e City agrees to construct service connections to two properties to allow <br /> <br />abandonment of eXisting service piping outSide easements that serve contiguous <br /> <br />I <br /> <br />Page 7 of 12 <br />
