<br />I <br /> <br />I <br /> <br />I <br /> <br />RESOLUTION 2007- 62 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING A CONSTRUCTION CONTRACT WITH H.O. <br />PERKINS CONSTRUCTION COMPANY, INC. ON AN EMERGENCY BASIS, <br />FOR THE SAN MARCOS POLICE DEPARTMENT EMERGENCY REPAIRS <br />PROJECT; RATIFYING THE CITY MANAGER'S EXECUTION OF THE <br />CONTRACT DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On January 13, 2007 the City Police Department building was damaged due to a <br />tornado that touched down on the west side of IH 35 South. The building suffered severe <br />structural damage which required immediate repair in order to restore the building to a safe and <br />secure condition. <br /> <br />2. The City engaged RO. Perkins Construction Company, Inc. for the necessary <br />work based on price, immediate availability and extensive experience in the work required for <br />this Project. <br /> <br />3. The City Council finds and determines that it was necessary to enter into this <br />construction contract on an emergency basis and without formal competitive bidding in order to <br />repair the City Police Department due to unforeseen damage in accordance with Section 252.022 <br />of the Local Government Code. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The award of a construction contract to H.O. Perkins Construction <br />Company, Inc. on an emergency basis, for the San Marcos Police Department Emergency <br />Repairs Project in the amount of $43,372.00 is approved. <br /> <br />PART 2.
