<br />TRACT 1: BASE ZONING: "GC" GENERAL COMMERCIAL DISTRICT <br /> <br />Street address: <br /> <br />Size: 113.133 acres, more or less. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit 1. <br /> <br />Deed or plat reference: Volume 2752, page 306 of the Official Public Records of Hays <br />County, Texas. <br /> <br />TRACT 2: BASE ZONING: "MU" MIXED USE DISTRICT <br /> <br />Street address: <br /> <br />Size: 6.032 acres, more or less. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit 1. <br /> <br />Deed or plat reference: In multiple documents, consecutively filed beginning at Volume <br />3074, page 30 of the Deed Records of Hays County, Texas. <br /> <br />SECTION 2. The PDD Land Use Plan for the Stone Creek Crossing Planned <br />Development District, as attached to this ordinance in Exhibits 1, 5, 6 and 7 is approved and <br />adopted to regulate the development of the Project Site. The Project Site will be bound by the <br />provisions of the Land Use Plan and the Development Standards as though they were conditions, <br />restrictions and limitations on use of the Project Site under the City's zoning ordinances. Any <br />person, firm, corporation or other entity violating any provisions of the Land Use Plan or the <br />Development Standards shall be subject to all penalties that apply to violation of the zoning <br />ordinances of the City of San Marcos, as amended. Any person, firm, corporation or other entity <br />violating any provisions of the Land Use Plan or the Development Standards shall be subject to a <br />suit by the City for an injunction to enjoin the violation as though the Land Use Plan and <br />Development Standards were conditions, restrictions and limitations on use of the Project Site <br />under the City's zoning ordinances. <br /> <br />SECTION 3. All zoning standards not expressly set forth for the district in this ordinance <br />shall be provided in the base zoning districts; and, any standard in Chapters 5, 6 and 7 of the <br />Land Development Code that has not been expressly varied in this ordinance shall be applicable <br />to subsequent development permits for land within the PD district. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City <br />Code upon conviction. <br /> <br />SECTION 5. After its original passage, this ordinance will be subject to reconsideration <br />at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is <br /> <br />2 <br />
