<br />RESOLUTION 2007- 45R <br /> <br />I <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE PURCHASE OF PERMANENT <br />AND TEMPORARY EASEMENTS OF 0.413 ACRES MORE OR LESS, <br />AND 0.016 AND 0.504 ACRES MORE OR LESS, IN CONNECTION <br />WITH THE RIVERSIDE MKT INTERCEPTOR PROJECT; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY <br />DOCUMENTS IN CONNECTION WITH THIS PURCHASE; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City .of San Marcas is gaing ta canstruct a large diameter waste water <br />main from east .of IH-35 ta Babcat Stadium. The Project requires the City ta .obtain <br />utility easements, rights-af-way or ather interests in certain real praperty in the vicinity .of <br />the Praject. <br /> <br />2. The permanent easement .of 0.413 acres is lacated an property awned by <br />St. Jahn's Cathalic Church, and is necessary for proper alignment .of the project The <br />temparary, warking easements are necessary far the canstructian .of the line. <br /> <br />3. The City has reached an agreement ta purchase 0.413 acres .of land <br />belanging ta St. Jahns, alang with twa temporary easements, at a cast .of $ 85,000.00. <br /> <br />I BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The purchase .of the easements, as more fully described an Exhibit 1, and the <br />twa attachments ta Exhibit 1 , is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is autharized ta execute all necessary <br />dacuments in cannectian with the purchase .of the abave described easements an <br />behalf .of the City. <br /> <br />PART 3.
