<br /> TEXAS TRANSPORTATION COMMISSION <br /> HA YS County MINUTE ORDER Page 10f2 <br /> <br /> District AUSTIN <br /> WHEREAS, in HA YS COUNTY, on INTERSTATE HIGHWAY 35 at Centerpoint Road, an <br /> interchange reconstruction project is currently being developed; and <br /> WHEREAS, this project is necessary due to increased daily traffic volumes around a major <br /> 06 ~ - ; /,hopping mall in the City of San Marcos (the "city'); and <br /> OF <br /> DC ! ~ WHEREAS, the city has requested that the interchange project be redeßigned at an increase <br /> m,~E t-t-- in cost to elevate the Interstate Highway 35 mainlanes over Centerpoint Road; and <br /> DT= rt-- <br /> DOA IT--.-- WHEREAS, the Texas Department of Transportation (the "department") concurs with the <br /> DCE t i more expensive redesign; and <br /> ROW <br /> ACCT WHEREAS, since the city has requested a different and more costly design than was <br /> P!a originally proposed, the city is committing $1,000,000 toward the project; and <br /> IR <br /> AA WHEREAS, the Texas Transportation Commission acknowledges the city's offer to assume <br /> AE partial fmancial responsibility for the development of the project; and <br /> ~L~ WHEREAS, this action is consistent with the 1997-2001 Strategic Plan strategy to plan, <br /> design, and manage highway projects; <br /> NOW THEREFORE, IT IS ORDERED that the executive director is directed to tender the <br /> following proposal to the city: <br /> Provided the city will: <br /> 1. Donate $1,000,000 toward the interchange reconstruction project at Interstate <br /> Highway 35 over Centerpoint Road. <br /> 2. Provide 100 percent of all right of way costs, and agree to provide for the adjustment of <br /> utilities in compliance with standards of the department. <br /> The department will: <br /> 1. Provide for the construction costs estimated at $4,300,000 to be funded in the Austin <br /> District's allocation of Category 2, Interstate Maintenance of the 1998 Unified <br /> Transportation Program <br /> 2. Provide design plans, specifications and estimates, right of way documentation, <br /> environmental documents and clearances, and let the project to contract. <br /> IT IS FURTHER ORDERED that when this Minute Order is declared operative, the <br /> executive director is authorized to proceed in the most feasible and economical manner with project <br />
