<br /> 85 <br /> EMPLOYMENTAGREEMÅ’NTBETWEEN <br /> THE CITY OF SAN MARCOS AND MARK B. T AYLOR <br /> FOR THE POSITION OF CITY ATTORNEY <br /> STATE OF TEXAS <br /> COUNTY OF HAYS KNOW ALL PERSONS BY THESE PRESENTS <br /> CITY OF SAN MARCOS <br /> THIS AGREEMENT made and entered into this 16th day of March, 1998, by and between the City <br /> of San Marcos, Texas, a municipal corporation, hereinafter called "Employer," and Mark B. Taylor, <br /> hereinafter called "Employee", both of whom understand as follows: <br /> WITNESSETH: <br /> WHEREAS, Employer desires to continue to employ the services of said Mark B. Taylor as City <br /> Attorney of the City of San Marcos, as provided by Sec. 4.04 of the City Charter; and <br /> WHEREAS, it is the desire of the governing body, hereinafter called "City Council," to provide <br /> certain benefits, to establish certain conditions of employment, and to set working conditions of said <br /> Employee; and <br /> WHEREAS, Employee desires to continue employment as City Attorney of said City of San Marcos; <br /> and <br /> WHEREAS, the parties acknowledge that Employee is a member of the State Bar of Texas, the bars <br /> of the United States District Courts for the Western and Southern Districts of Texas, and the Texas <br /> City Attorney's Association (TCAA), and that Employee is subject to the rules of professional <br /> responsibility of these organizations; <br /> NOW THEREFORE, in consideration of the mutual covenants herein contained, the parties agree <br /> as follows: <br /> Section 1: Duties <br /> Employer hereby agrees to employ said Mark B. Taylor as City Attorney of said Employer to <br /> perform the functions and duties specified in said Sec. 4.04 of the City Charter and applicable <br /> provisions of the City Code and to perform other legally permissible and proper duties and functions <br /> as the City Council shall from time to time assign. <br /> Section 2: Term <br /> A. Employee agrees to remain in the exclusive employ of Employer during the term of this <br /> agreement, and agrees not to become employed by any other employer until said termination as <br /> hereinafter provided, except as provided in Section 10 hereof. <br /> 1 <br />
