<br /> - 3 - <br /> injuries to and deaths of persons including employees of the <br /> Licensee, and damages to any property growing out of, incident to, <br /> or in any manner resulting from the construction, maintenance or use <br /> of the Improvements, to the fullest extent allowed by law. <br /> 4. T enninati on: <br /> <br /> (a) If the Licensee fails to perform any of its obligations, the City may <br /> tenninate this Agreement by giving to the Licensee not less than <br /> thirty (30) days' advance written notice of its intention to do so. <br /> (b) Either the City or the Licensee may terminate this agreement at any <br /> time by giving to the other party not less than ninety (90) days' <br /> advance written notice of its intention to do so. <br /> (c) The Licensee agrees to restore the License Area to its condition as it <br /> existed prior to the making of the Improvements, insofar as <br /> practicable, promptly upon its issuance to the City, or its receipt <br /> from the City, of any notice to terminate this Agreement. <br /> (d) The Licensee's obligations under Section 3(c) above will survive any <br /> termination of this Agreement and will continue in effect for ten <br /> years after the tennination. <br />
