<br /> ~ <br /> cr-" <br /> - 150 <br /> - <br /> ORDINANCE 1998- 24 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING A 1.071 ACRE TRACT OF <br /> PROPERTY LOCATED AT 2112 IH-35 NORTH FROM "R-1" <br /> SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) TO <br /> "C" COMMERCIAL DISTRICT; INCLUDING PROCEDURAL <br /> PROVISIONS; AND PROVIDING FOR PENAL TIES. <br /> RECITALS: <br /> 1. On March 24, 1998, the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "R-1" Single- <br /> Family Dwelling District (Low Density) to "C" Commercial District for a 1.071 acre tract of <br /> property located at 2112 IH-35 North. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on March 24, 1998 consider and vote to approve the request, and has <br /> recommended that the request be approved by the City Council of the City. <br /> 3. The City Council held a public hearing on the 27th day of <br /> April , 1998, regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br /> to zoning map amendments have been met. <br /> 5. The City Council hereby finds and determines that the adoption of the following <br /> ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br /> of the San Marcos City Code, is amended to rezone the following real property which is <br /> presently zoned "R-1" Single-Family Dwelling District (Low Density) to "C" Commercial <br /> District: <br /> Street address: 2112 IH-35 North <br /> Size: 1.071 acres. <br /> Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br /> Deed or plat reference: Volume 1214, page 156, Hays County Deed Records. <br /> <br /> SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br /> Plan is revised to conform to this zoning map amendment. <br /> SECTION 3. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 4. After its original passage, this ordinance will be subject to <br /> reconsideration at the next regular City Council meeting. If this ordinance is not <br /> reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br /> in a newspaper of general circulation in the City. This ordinance will take effect upon <br /> publication of this notice. <br />
