<br /> 160 <br /> RESOLUTION 1998 - 82R <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF <br /> THE CITY OF SAN MARCOS, TEXAS <br /> APPROVING THE SALE OF A TRACT OF <br /> SURPLUS REAL PROPERTY AT THE <br /> INTERSECTION OF ROOSEVELT STREET <br /> AND GUADALUPE STREET TO WITTING AND <br /> MILLER, INC.; AUTHORIZING THE CITY <br /> MANAGER TO EXECUTE A DEED FOR THIS <br /> PROPERTY; AND DECLARING AN EFFECTIVE <br /> DATE. <br /> RECITALS: <br /> 1. The City is the owner of the 1 ,110 square foot portion of real property as described <br /> in the deed attached to this resolution. <br /> 2. A staff analysis has been made that has determined that there is no present or <br /> anticipated future need for the City to retain this property. <br /> 3. This tract of property cannot be used independently because of its shape and small <br /> area, and the property is therefore eligible for sale to the abutting property owners, Witting <br /> and Miller, Inc., for its fair market value as determined by an appraisal obtained by the <br /> City. <br /> 4. The City has complied with the requirements of Section 272.001 (b)(1) of the Texas <br /> Local Government Code regarding the sale of surplus real property. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The sale of the parcel of real property described in Recital 1 above <br /> for $ 1,110 to Witting and Miller, Inc. is approved. <br /> PART 2. The City Manager, Larry D. Gilley, is authorized to execute the <br /> attached Special Warranty Deed conveying to Witting and Miller, Inc. the property <br /> described above. <br /> PART 3.
