<br />AMENDMENTS; AND DECLARING AN EMERGENCY.

<br />RECITALS:
<br />
<br />1. The City Council ordered that a Special and General election be held on May
<br />2, 1998 for the purpose of electing a Mayor, a City Council Member, Place 1, and a City
<br />Council Member, Place 2, and submitting propositions to the voters regarding City Charter
<br />Amendments.
<br />
<br />2. Notice of this election was duly published in the San Marcos Daily Record on
<br />April 5, 1998.
<br />
<br />3. Copies of this notice were duly posted at each city election precinct polling
<br />place prior to the election, and a copy of the notice was posted on the bulletin board at City
<br />Hall on February 12, 1998.
<br />
<br />4. This election was duly and legally held on the 2nd day of May, 1998, in
<br />conformity with the election laws of the State of Texas, and the results of the election have
<br />been certified and returned by the proper judges and clerks.
<br />
<br />5. The City Council of the City of San Marcos, Texas with the following
<br />members present: Mayor Billy G. Moore, Ed Mihalkanin, Jane Hughson, Ronald
<br />K. Hart, Fred Guerra, Joe B. Cox, Jr. and Rick Hernandez
<br />and has today
<br />considered the returns of the Special and General election held on the 2nd day of May,
<br />1998.
<br />
<br />6. It appears to the Council, and the Council finds, that the election was in all
<br />respects lawfully held.
<br />
<br />7. It appears to the Council, and the Council finds, that the tabulation of the
<br />results of the election is correct.
<br />
<br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br />
<br />SECTION 1. The Special and General City election of May 2, 1998 was duly called,
<br />notice of the election was given in accordance with law, and the election was held in
<br />accordance with law.
<br />
<br />SECTION 2. The tabulation of votes cast in the Special and General election held
<br />on May 2, 1998 for the purposes stated in Recital 1 above, a copy of which is attached to
<br />and made a part of this ordinance, is adopted as the official tabulation of the votes cast at
<br />the election, and the tabulation will be filed and recorded in the official records of the City
<br />of San Marcos as the official canvass of the election.
<br />
<br />SECTION 3. The official canvass of the returns of the election reflects the following:
<br />
<br />A. No candidate for the positions of Mayor, City Council Member Place 1 or City
<br />Council Member Place 2 received a majority of the votes cast.

<br />B. The following votes were cast for and against the following numbered
<br />propositions:
