<br /> 25. <br /> ORDINANCE 1998- 36 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING THE ABANDONMENT OF THE PORTION <br /> OF THE 15 FOOT ALLEYWAY LOCATED BETWEEN LOT E OF <br /> SCHNEIDER'S REARRANGEMENT IN BLOCK 10 OF WESTOVER <br /> ADDITION, AND LOTS 81 AND 82, BLOCK 10 OF WESTOVER ADDITION, <br /> ADJACENT TO THE 1300 BLOCK OF BAYLOR STREET; APPROVING <br /> THE CONVEYANCE OF THIS ALLEYWAY TO JOE AND LAURA <br /> SCHNEIDER; AUTHORIZING THE CITY MANAGER TO EXECUTE A <br /> DEED; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. On February 24, 1998, the City Planning and Zoning Commission conducted <br /> a public hearing on the proposed abandonment of the 15 foot alleyway between Lot E of <br /> the Schneider's Rearrangement in Block 10 of Westover Addition, and Lots 81 and 82, <br /> Block 10 of the Westover Addition, located adjacent to the 1300 block of Baylor Street, and <br /> voted unanimously to approve the proposal. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SE;CTION 1. The abandonment of the 15 foot alleyway between Lot E of the <br /> Schneider's Rearrangement in Block 10 of Westover Addition, and Lots 81 and 82, Block <br /> 1 0 of the Westover Addition, located adjacent to the 1300 block of Baylor Street is <br /> approved. <br /> SECTION 2. The City Manager, Larry D. Gilley, is authorized to execute the <br /> Quitclaim Deed attached to this ordinance conveying to Joe Schneider and Laura <br /> Schneider the portion of the 15 foot alleyway described above, without cash <br /> consideration. <br /> SECTION 3. This Ordinance will take effect 10 days after the date of its final <br /> passage, and the City Secretary will publish notice of its adoption in a newspaper of <br /> general circulation in the City. <br /> PASSED AND APPROVED on first reading April 13, 1998. <br /> PASSED AND APPROVED on second reading April 27, 1998. <br /> PASSED, APPROVED AND ADOPTED May 11, 1998. <br /> ))~~,~ <br /> Billy G.
