C\¡)a <br />Ç><) <br />Ù- ß; 8 ORDINANCE 1998 - " G <br />~ <:ü <br />- t;:¡::?. <br />'---, 5 ¡ij AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />"-- ~ ~ MARCOS, TEXAS, PROVIDING FOR AN EXEMPTION TO TIMED <br />¡; PARKING RESTRICTIONS FOR HOTEL GUESTS BY AMENDING <br />Q ARTICLE 4 AND ADDING ARTICLE 7 TO CHAPTER 82, TRAFFIC AND <br />VEHICLES, OF THE SAN MARCOS CITY CODE; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Chapter 82, Article 4, of the San Marcos City Code is amended <br />by adding a new Section 82.181 to read as follows: <br /> <br /> <br />Sec. 82.181. Parking Privileges. <br /> <br />(a) The owner of a vehicle is exempt from the payment of a fee or penalty <br />imposed by the City for parking in a space with a limitation on the length of time for <br />parking if a valid hospitality tag, issued under Section 82.292 of this Code, is hung from <br />the rearview mirror of the vehicle or placed on the vehicle's front dashboard. <br /> <br />(b) This section does not permit a vehicle to be parked at a time when or a <br />place where parking is prohibited, or limited to certain vehicles such as loading zones, <br />public carrier stops or handicapped spaces. <br /> <br />SECTION 2. Chapter 82 of the San Marcos City Code is amended by adding <br />a new Article 7, to read as follows: <br /> <br />ARTICLE 7. PARKING HOSPITALITY TAGS <br /> <br />Sec. 82.290. Definitions. <br /> <br />Words and terms defined in V.TC.A., Tax Code § 351.001, shall have the same <br />meaning when used in this Article. <br /> <br />Sec. 82.291. Who may issue hospitality tags. <br /> <br />Only persons required under Section 78.1 02(d) of this Code to collect the hotel <br />occupancy tax are authorized to issue parking hospitality tags. <br /> <br />Sec. 82.292. Parking hospitality tag eligibility. <br /> <br />A person who pays the City's hotel occupancy tax may be issued a parking <br />hospitality tag valid for the number of days for which the tax is paid. This tag exempts the <br />holder from fees or penalties imposed for parking in time-restricted parking spaces, as <br />provided in Section 82.181 of this Code. <br /> <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />other provisions of this ordinance will continue in force if they can be given effect without <br />the invalid portion. <br /> <br />SECTION 5. All ordinances and resolutions or parts of ordinances or <br />resolutions in conflict with this ordinance are repealed. <br /> <br />SECTION 6. Any person violating a provision of this ordinance commits a <br />misdemeanor and is subject to the penalties provided for in Sections 1.015 or 82.159, <br />
