'---, 5 ¡ij AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN "-- ~ ~ MARCOS, TEXAS, PROVIDING FOR AN EXEMPTION TO TIMED ¡; PARKING RESTRICTIONS FOR HOTEL GUESTS BY AMENDING Q ARTICLE 4 AND ADDING ARTICLE 7 TO CHAPTER 82, TRAFFIC AND VEHICLES, OF THE SAN MARCOS CITY CODE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Chapter 82, Article 4, of the San Marcos City Code is amended by adding a new Section 82.181 to read as follows: Sec. 82.181. Parking Privileges. (a) The owner of a vehicle is exempt from the payment of a fee or penalty imposed by the City for parking in a space with a limitation on the length of time for parking if a valid hospitality tag, issued under Section 82.292 of this Code, is hung from the rearview mirror of the vehicle or placed on the vehicle's front dashboard. (b) This section does not permit a vehicle to be parked at a time when or a place where parking is prohibited, or limited to certain vehicles such as loading zones, public carrier stops or handicapped spaces. SECTION 2. Chapter 82 of the San Marcos City Code is amended by adding a new Article 7, to read as follows: ARTICLE 7. PARKING HOSPITALITY TAGS Sec. 82.290. Definitions. Words and terms defined in V.TC.A., Tax Code § 351.001, shall have the same meaning when used in this Article. Sec. 82.291. Who may issue hospitality tags. Only persons required under Section 78.1 02(d) of this Code to collect the hotel occupancy tax are authorized to issue parking hospitality tags. Sec. 82.292. Parking hospitality tag eligibility. A person who pays the City's hotel occupancy tax may be issued a parking hospitality tag valid for the number of days for which the tax is paid. This tag exempts the holder from fees or penalties imposed for parking in time-restricted parking spaces, as provided in Section 82.181 of this Code. SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 6. Any person violating a provision of this ordinance commits a misdemeanor and is subject to the penalties provided for in Sections 1.015 or 82.159,
