<br /> 103 <br /> OVERSIZE REIMBURSEMENT AGREEMENT FOR <br /> WATER LINE IMPROVEMENTS <br /> STATE 0 F TEXAS <br /> COUNTY OF HAYS <br /> This Agreement is made on this ~ day of June , 1998 between the City of San <br /> Marcos, a Texas municipal corporation (the "City"), and Terrand, Inc., a Texas corporation <br /> ("Terrand"). <br /> RECITALS <br /> 1. The Subdivision Chapter of the City Code provides for the installation of certain public <br /> improvements, including an allocation of the cost of the improvements. <br /> 2. The City, through its Public Works Department, requested that a water line constructed by <br /> T errand to serve the Wyatt Addition be oversized to provide for the City's eventual construction of the <br /> Northwest Water System Improvements Project. <br /> 3. The City is willing to participate with Terrand in the cost of constructing this line. <br /> AGREEMENT <br /> The City and Terrand, in consideration ofthe mutual promises, covenants and agreements set <br /> forth in this Agreement, agree and contract as follows: <br /> 1. Terrand has agreed to construct, and has constructed, improvements to the City's water <br /> system in the form of a 16 inch diameter ductile iron water main (the "Improvements") from the <br /> western end of the existing City water main along Ranch Road 12, west and parallel to the North <br /> right-of-way line of Ranch Road 12 to the Wyatt Addition, as described on the construction plans for <br />
