<br />~ 1.11 <br />Q:: <br />'" <br />,-() <br />0 <br /> ORDINANCE 1998- 49 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY ZONING A 4.56 ACRE TRACT OF <br /> PROPERTY LOCATED IN THE 400 BLOCK OF <br /> STAGECOACH TRAIL AS "ZL" ZERO LOT LINE DWELLING <br /> DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL <br /> PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> RECITALS: <br /> 1. On June 9, 1998, the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to establish a zoning to "ZL" Zero Lot <br /> Line Dwelling District (Medium Density) for a 4.56 acre tract of property located in the 400 <br /> Block of Stagecoach Trail. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on June 9. 1998 consider and vote to approve the request, and has <br /> recommended that the request be approved by the City Council of the City. <br /> <br /> 3. The City Council held a public hearing on the 22ND day of <br /> ,IIJNE , 1998, regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br /> to zoning map amendments have been met. <br /> 5. The City Council hereby finds and determines that the adoption of the following <br /> ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br /> of the San Marcos City Code, is amended to zone the following real property as "ZL" Zero <br /> Lot Line Dwelling District (Medium Density): <br /> Street address: 2200 Block of Garden Court. <br /> Size: 4.56 acres. <br /> Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br /> Deed or plat reference: Volume 1196, page 56, Hays County Official Records. <br /> <br /> SECTION 2. The designation of this property as Low Density Residential on the <br /> Future Land Use Plan of the San Marcos Horizons City Master Plan is retained. <br /> <br /> SECTION 3. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 4. After its original passage, this ordinance will be subject to <br /> reconsideration at the next regular City Council meeting. If this ordinance is not <br /> reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br /> in a newspaper of general circulation in the City.
