<br />147 <br /> <br /> <br />ORDINANCE NO. 1998.:::áL <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS AMENDING THE CITY BUDGET <br />ORDINANCE FOR THE 1997-98 FISCAL YEAR TO PROVIDE <br />FUNDING FOR THE CENTER POINT TRANSMISSION MAIN <br />PROJECT AND DECLARING EMERGENCY <br /> <br />RECITALS: <br /> <br />1. In accordance with Section 8.16 of the City Charter of the City of San Marcos, <br />Texas, the City Council declares that a public necessity exists which requires amendment <br />of the City's 1997-98 budget. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The City Budget Ordinance for the 1997-98 Fiscal Year is amended <br />as set forth in the attached Exhibit A, in order to provide funds for the Center Point <br />Transmission Main Project. <br /> <br />SECTION 2. These revisions and reappropriations which shall be the amended <br />budget for the City of San Marcos, Texas, for the fiscal year 1997-98, are approved and <br />adopted. <br /> <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 5. The importance of this Ordinance creates an emergency and an <br />imperative public necessity, and the provisions of the Charter requiring that ordinances be <br />presented at three separate meetings, and that ordinances do not take effect until 1 0 days <br />after the date of final passage are suspended, and this Ordinance will take effect upon <br />publication of notice of its adoption in a newspaper of general circulation in the City. <br /> <br />PASSED, APPROVED AND ADOPTED this 13 day of July , 1998. <br /> <br /> <br />~~~ <br /> <br />Billy G.
