<br /> 176 <br /> RESOLUTION 1998- 140 R <br /> <br /> A RESOLUtiON OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, RECOMMENDING THE SUPPORT OF THE <br /> TEXAS MUNICIPAL LEAGUE FOR STATE LEGISLATION TO <br /> BROADEN COUNTY SUBDIVISION PLATTING AUTHORITY; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> Recitals: <br /> 1. More than ever before in the State's history, substantial growth and new <br /> development is taking place outside of Texas cities under the primary jurisdiction of Texas <br /> counties. <br /> 2. The State Legislature has expressly granted authority to Texas counties to <br /> review plats for the creation of new subdivisions outside of cities to protect the health, <br /> safety and welfare of county residents. <br /> 3. The exercise of these powers by Texas counties is important to the orderly <br /> and healthy growth of areas outside cities in a manner that protects the future residents <br /> of new subdivisions and the value of surrounding properties. <br /> 4. The recent Elgin Bank court decision interpreted State statutes regarding <br /> county subdivision platting authority in a manner that has created opportunity and incentive <br /> for subdivision developments without adequate roadway and utility facilities and services, <br /> and without any platting review by county officials. <br /> 5. Hays County has experienced a number of such substandard developments, <br /> posing a hardship on taxpayers, endangering public health, and undermining surrounding <br /> property values. <br /> 6. Such substandard developments put legitimate, well-planned and properly <br /> reviewed subdivisions at a competitive disadvantage, and tend to tarnish the image of the <br /> broader real estate and development industries in the public mind. <br /> 7. Such substandard developments make it more difficult and more costly for <br /> counties, school districts and emergency service districts to deliver public services safely <br /> and efficiently. <br /> 8. The problems caused by such substandard developments will ultimately <br /> impede the future growth of Texas cities and impose disproportionate burdens on City <br /> taxpayers and utility ratepayers. <br /> BE IT REgOL VED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The City of San Marcos urges the Texas Municipal League to support <br /> State legislation to broaden county subdivision platting authority and close loopholes that <br /> permit substandard development,in order to alleviate the concerns described above and <br /> provide for higher quality, sustainable growth throughout the State of Texas. <br /> PART 2.
