<br /> 177 <br /> RESOLUTION 1998--J.4.F <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS RECOMMENDING THE SUPPORT <br /> OF THE TEXAS MUNICIPAL LEAGUE FOR STATE <br /> LEGISLATION TO GRANT ZONING AUTHORITY TO TEXAS <br /> COUNTIES ON A LOCAL OPTION BASIS; AND DECLARING <br /> AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. Texas cities have long had the authority, expressly granted by the State Legislature, to <br /> adopt and enforce zoning regulations to promote the public health, safety, morals and <br /> welfare. <br /> 2. Zoning authority allows Texas cities to plan for and provide adequate transportation, <br /> water, sewers, schools, parks and other public facilities and municipal services, to lessen <br /> congestion in the streets, to prevent the overcrowding of land, and to avoid undue <br /> concentration of population. <br /> 3. Texas counties have historically lacked the authority to enact zoning regulations to <br /> accomplish these same public purposes. <br /> 4. The Îack of county zoning authority has often led to substandard, unplanned <br /> development around the periphery of Texas cities, giving rise to problems in the provision <br /> of public facilities and services that the cities often inherit as they grow into county areas. <br /> 5. State legislation to expressly grant zoning authority to Texas counties on a local option <br /> basis would allow the counties to more effectively govern and control the nature and quality <br /> of development in county areas, and thereby more effectively meet their obligations to <br /> promote the public health, safety, morals and welfare. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: <br /> PART 1. The City of San Marcos urges the Texas Municipal League to support State <br /> legislation to expressly grant zoning authority to Texas counties on a local option basis. <br /> PART 2.
