<br /> 11 <br /> RESOLUTION 1998- 155 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS APPROVING AN EXTENSION OF THE CITY'S <br /> WASTEWATER SYSTEM TO THE PROPERTY AT 128 SPRING <br /> ROAD; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. City Code Section 86.003(c) requires City Council approval for the extension <br /> of City wastewater mains to serve uses outside the City limits. <br /> 2. Mr. David Rakowitz (the "Owner") has requested permission to extend a City <br /> wastewater main to serve the property at 128 Spring Road, (the "Property"), which is <br /> outside the city limits. <br /> 3. This wastewater main extension appears to be feasible and is to be <br /> constructed at the sole expense of the Owner of the Property. <br /> 4. The City Council is willing to approve this request on the express condition <br /> that the Owner, on behalf of itself, its successors and assigns, consents to the annexation <br /> of the Property at such time as it is adjacent to the City limits. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That an extension of the City's wastewater system to serve the Property <br /> is approved, subject to the express condition stated in Recital 4 above. <br /> PART 2.
