SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is revised to change the future land use designation for the following real property from "LDR" Low Density Residential, "C" Commercial, "P" Public and Institutional, and "I" Industrial to "MU" Mixed Use: Street address: Northwest Corner of Old Stagecoach and Post Road Size: 575.137 acres, more or less, comprising 8 tracts of land. Legal description: See legal description in the attached supporting materials for LUA-06- 17. Deed or plat reference: Tract 1 : Volume 2396, page 776; Tract 2: Volume 2396, page 793; Tract 3: Volume 2419, page 435; Tract 4: Volume 2396, page 801; Tract 5: Volume 2396, page 776; Tract 6: Volume 2494, page 627; Tract 7: Volume 2494, page 616, Tract 8: Volume 2494, page 627, all found in the Official Deed Records of Hays Count y. SECTION 2. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the City Land Development Code, is amended to rezone the tract of real property described in Section 1 above from "PH-ZL" Patio Home-Zero Lot Line, "SF-6" Single Family Residential, "P" Public and Institutional, "NC" Neighborhood Commercial, and "FD" Future Development to "MU" Mixed Use District. SECTION 3. Any person violating any prOVISIon of this ordinance commits a misdemeanor and is subj ect to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 4. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice.
