ORDiNANCE 2003- 23 <br /> <br /> AN ORDiNANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS. <br /> TEXAS, CANVASSiNG RETURNS AND DECLARING RESULTS OF THE <br /> GENERAL ELECTION, HELD ON MAY 3, 2003 FOR THE PURPOSE OF <br /> ELECTiNG A CITY COUNCIL MEMBER, PLACE 5, AND A CITY COUNCIL <br /> MEMBER, PLACE 6; AND DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br /> 1. The City Council ordered that a General Election be held on May 3, 2003 <br />purpose of electing a Council Member, Place 5, and a Council Member, Place 6. <br /> <br /> 38. <br /> <br />O ~ <br /> <br />6,2003. <br /> <br />Notice of this election was duly published in the San Marcos Daily Record on April <br /> <br />2003. <br /> <br />A copy of the notice was posted on the bulletin board at City Hall on Februm'y 28, <br /> <br /> 4. This election was duly and legally held on May 3, 2003, in conformity with the <br />election laws of the State of Texas, and the results of the election have been certified and returned <br />by the proper judges and clerks. <br /> <br /> 5. The City Council of the City of San Marcos, Texas with the following members <br />present: Ed Mihalkanin, Jacob Montoya, Susan Narvaiz, Mayor Habingreither, <br /> <br />Bill Taylor, Paul Mayhew and Martha ~ax~u~oday considered the returns of the <br />General election held on May 3, 2003. <br /> <br /> 6. It appears to the Council, and the Council finds, that the election was in all respects <br />lawfully held. <br /> <br /> 7. It appears to the Council, and Council finds, that the tabulation of the result of the election <br />is correct. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> SECTION 1. The General Election of May 3,2003 was duly called, notice of the election was <br />given in accordance with law, and the election was held in accordance with the law. <br /> <br /> SECTION 2. The tabulation of votes cast in the General election held on May 3, 2003 for the <br />purposes stated in recital 1 above, a copy of which is attached to and made a part of this <br /> <br /> <br />
