<br /> ~"..., <br /> '.... 0:::: <br /> .~ « <br /> '- G:J 58 <br /> f"~~ 0::::. <br /> Q <br /> C¡ w <br /> v;r. <br /> ORDINANCE 1998---5B <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING A 1.293 ACRE TRACT OF <br /> PROPERTY LOCATED AT 1600 POST ROAD FROM "I" <br /> INDUSTRIAL DISTRICT TO "C-2" HEAVY COMMERCIAL <br /> DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br /> PROVIDING FOR PENAL TIES. <br /> RECITALS: <br /> 1. On July 14, 1998, the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "I" Industrial <br /> District to "C-2" Heavy Commercial District for a 1.293 acre tract of property located at <br /> 1600 Post Road. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on July 14, 1998 consider and vote to approve the request, and has <br /> recommended that the request be approved by the City Council of the City. <br /> 3. The City Council held a public hearing on the 14th day of <br /> September , 1998, regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br /> to zoning map amendments have been met. <br /> 5. The City Council hereby finds and determines that the adoption of the following <br /> ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br /> of the San Marcos City Code, is amended to rezone the following real property which is <br /> presently zoned "I" Industrial District to "C-2" Heavy Commercial District: <br /> Street address: 1600 Post Road <br /> Size: 1.293 acres. <br /> Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br /> Deed or plat reference: Volume 139, page 82-86, Hays County Deed Records. <br /> <br /> SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br /> Plan is revised to conform to this zoning map amendment. <br /> SECTION 3. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 4. After its original passage, this ordinance will be subject to <br /> reconsideration at the next regular City Council meeting. If this ordinance is not <br /> reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br /> in a newspaper of general circulation in the City. This ordinance will take effect upon <br /> publication of this notice. <br /> PASSED, APPROVED AND ADOPTED this 14th day of September ,1998, <br /> subject to reconsideration at the next regular City Council meeting scheduled for <br />
