L <br /> and to relocate all of the Lessee's buildings at no cost to the Lessee, or provide similar facilities for <br /> the Lessee, except that the Lessor shall not be required to pay more than the wholesale cost of <br /> foundation materials. <br /> 14.05. This Lease shall be subject to and in conformance with all City, State and Federal <br /> ordinances, statutes and regulations. <br /> 14.06. The Lessee, for itself, its personal representatives, successors in interest, and assigns, as <br /> part of the consideration, hereby covenants and agrees as a covenant running with this Lease that: <br /> 1) no person shall be excluded from participation in, denied the benefits of, or be otherwise <br /> subjected to discrimination in the use of the Leased Premises on the grounds of sex, race, creed, <br /> color, or national origin, 2) no person shall be excluded from participation in, denied the benefits of, <br /> or otherwise be subjected to discrimination on the grounds of sex, race, creed, color, or national <br /> origin in the construction of any improvements on, over, or under the Leased Premises, and 3) the <br /> Lessee shall use the premises in compliance with all other requirements imposed by 49 CFR Part <br /> 21, Nondiscrimination in Federally Assisted Programs of the Department of Transportation, as <br /> amended. In the event of breach of this covenant, the Lessor shall have the right to terminate the <br /> Lease and to reenter and repossess the Leased Premises in accordance with Article 11. <br /> 14.07. During the time of war or national emergency, the Lessor shall have the right to lease all or <br /> part of the landing areas at the Airport to the Federal government for military use, and, if a lease is <br /> executed, the provisions of this Lease shall be suspended to the extent they are inconsistent with <br /> the provisions of the lease to the government. <br /> 14.08. Th~ Lessor shall have the right to enter the Leased Premises at all reasonable hours for the <br /> purpose of inspection. The Lessor shall not be liable to the Lessee for any expense, loss, or <br /> damage from any such entry upon the Leased Premises. <br /> Article 15. Miscellaneous <br /> 15.01. When the singular number is used in this Lease, it will include the plural when appropriate, <br /> and the neuter gender will include the feminine and masculine genders when appropriate. <br /> 15.02. If any clause or provision of this Lease is illegal, invalid or unenforceable under present or <br /> future laws, this Lease will remain in effect, and the remaining provisions will continue in force if they <br /> can be given effect without the invalid portion. <br /> 15.03. This Lease may be amended only by an instrument in writing signed by both parties. This <br /> Lease shall apply toand be binding upon the parties, and upon their respective successors in interest <br /> and legal representatives, unless otherwise expressly provided in this Lease. <br /> 15.04. The captions used in this Lease are for convenience only and do not in any way limit or <br /> amplify the terms and provisions of this Lease. <br /> 15.05. One or more waivers of any covenant, term or condition of this Lease by either party shall <br /> not be deemed as a waiver by that party as to any subsequent similar act or omission. <br /> 9 <br />
