The Lessor agrees that the Lessee shall have access to the runways, taxiways and ramps at <br /> the Airport to the same extent as other Airport users. The Lessor's failure to continue the use of the <br /> Airport for airport ,and aviation purposes shall constitute a default. The Lessee may give notice to <br /> the Lessor of such a default, and if the Lessor fails to cure the default within 30 days after receiving <br /> the notice, this Lease shall terminate, and the Lessee shall vacate the Leased Premises within 120 <br /> days after the date the Lessor received the notice. Until the Lessee vacates the Leased Premises, <br /> the normal rental fees shall accrue. The date the Lessee vacates the Leased Premises shall be the <br /> date the Lessee is released from accruing further obligations under this Lease. <br /> Article 4. Maintenance and Repair of Premises <br /> 4.01. The Lessee shall maintain the Leased Premises in good, clean condition and shall make all <br /> repairs to structures and improvements on the premises needed to maintain their function, safety <br /> and appearance. The Lessee shall comply with all governmental laws, ordinances and regulations <br /> that apply to the Leased Premises, at its sole cost and expense. If the Lessee fails to make any <br /> required repairs required within 30 days after written notice from the Lessor, the Lessor may make <br /> the repairs without liability to the Lessee for any loss or damage which may result to the Lessee by <br /> reason of the repairs, and the Lessee shall pay to the Lessor the full cost of the repairs within 30 <br /> days of the Lessor's issuance of a written invoice to the Lessee. At the expiration of this Lease, the <br /> Lessee shall surrender the Leased Premises in good condition, reasonable wear and tear excepted. <br /> 4.02. The Lessor will use airport revenue funds to maintain the existing runways, taxiways, and <br /> entrance roads on the Airport. The Lessor shall not be obligated to use general, operating or bond <br /> funds for this maintenance. <br /> Article 5. Construction of Hangar; Alterations and Fixtures <br /> 5.01. Within 12 months of the commencement of this Lease, the Lessee shall complete the <br /> construction of an aircraft storage hangar (the "Hangar") on the Leased Premises in accordance with <br /> sealed plans prepared by an architect or structural engineer licensed or registered in the State of <br /> Texas. The plans will depict the total construction project for the Hangar, and will be accompanied <br /> by the architect or engineer's estimated cost of the construction and the time schedule for <br /> completion of the construction. The plans and the time schedule shall be subject to approval by the <br /> City. <br /> 5.02 The Lessee shall not make any further alterations, additions, or improvements to the Leased <br /> Premises without the advance written consent of Lessor. All improvements, alterations, additions <br /> and fixtures which may be made or installed upon the Leased Premises shall become the property <br /> of the Lessor and shall remain upon and be surrendered with the Leased Premises at the termination <br /> of this Lease, unless the Lessor requests their removal, in which event the Lessee shall remove <br /> them and restore the Leased Premises at the Lessee's expense. <br /> 5.03. The Lessee may mortgage its leasehold interest in the Leased Premises for the purpose of <br /> obtaining funding for the construction of the Hangar or other improvements on the Leased Premises. <br /> The Lessee shall obtain the advance written consent of the Lessor for each such mortgage. The <br /> Lessee shall ensure that no other lien or similar obligation is imposed upon the Leased Premises <br /> for any alteration, repair, labor performed or materials furnished to the Leased Premises, and the <br /> Lessee shall immediately discharge any lien or charge after the lien occurs or charges become due <br /> 3 <br />
