This Agreement will be binding upon, and inure to the benefit of, the parties and their respective
heirs, successors, legal representatives and assigns.
The following obligations of the City will survive the closing:
1. The City will install no more than three new water or wastewater utility lines within the
easement.
2. The City will maintain the surface of the easement.
3. The City's policy is to require permission by the City to be granted for connections to City
water and wastewater lines for property outside the city limits, and your remaining property
contiguous to the easement is presently outside the city limits. The City grants permission
for you, and your successors in title, to make connections to City water and wastewater lines,
in conformity with the City's usual connection and fee policies, to serve your remaining
property contiguous to the easement. Connection to water and wastewater transmission lines
within the easement, however, will not be permitted. No fee will be charged by the City for
the connection of new mains to serve your remaining property contiguous to the easement.
4. The City will excavate and refill for the construction of pipelines within the easement
using a process that separates topsoil from subsoil and replaces topsoil where found, to the
extent practicable.
Please countersign both originals of this agreement, and return one of them to me, keeping the other
one for your records.
Thank you for your cooperation and assistance in this matter.
City of San Marcos
~~/d.6~
L D. @.lley, City ager
Ernest cumm?~
p- íJ.- - 7
Date
