(Ç <br />~ 8- LY:!æ <br />: ., "ü 0-' 0::: - ¡¡;;; <br />~ QI) <br />i:)l 0 !.!.I" <br /> (1)"15 <br />~ <br />\"'. <br /> ORDINANCE 1998- 68 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING ARTICLE 2, MASTER PLAN, OF <br /> CHAPTER 102, PLANNING, OF THE CITY CODE TO AMEND THE <br /> SAN MARCOS HORIZONS CITY MASTER PLAN ADOPTED IN <br /> SECTION 102.026 BY ADOPTI NG A NEW CHAPTER 4, <br /> ANNEXATION REVIEW PLAN; INCLUDING PROCEDURAL <br /> PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> RECITALS: <br /> 1. Section 102.026 of the City Code adopts the San Marcos Horizons City <br /> Master Plan as the master plan for the physical development of the City. <br /> 2. The Director of Planning and Development Services has prepared a revised <br /> and updated Chapter 4, Annexation Review Plan, of the master plan. <br /> 3. The Planning and Zoning Commission has conducted a public hearing on this <br /> revised Chapter 4, and has voted to recommend the adoption of the revised Chapter 4 by <br /> the City Council. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The San Marcos Horizons City Master Plan adopted in Section <br /> 102.026 of the City Code is amended by the adoption of the revised Chapter 4, Annexation <br /> Review Plan, in the form attached to this ordinance in place of the Chapter 4 contained in <br /> the original master plan. <br /> SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance <br /> is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br /> provisions of this ordinance will continue in force if they can be given effect without the <br /> invalid portion. <br /> SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 4. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 5. This Ordinance will take effect 10 days after the date of its final <br /> passage, and the City Secretary will publish notice of its adoption in a newspaper of <br /> general circulation in the City. <br /> PASSED AND APPROVED on first reading September 14, 1998. <br /> PASSED AND APPROVED on second reading SEPTEMBER 28, 1998. <br /> PASSED, APPROVED AND ADOPTED OCTOBER 12,1998. <br /> ~~~~~ <br /> Mayor <br />
