<br /> SECTION 2. Section 2.352 of the City Code is amended as follows (overstrike <br /> indicates deleted wording): <br /> Sec. 2.352. General powers and duties. <br /> (a) The Convention and Visitors Bureau Board will advise and provide <br /> oversight for contracts between the city and the San Marcos Area Chamber of <br /> Commerce for programs for the promotion of tourism within the city. <br /> (b) The board will: <br /> (1) Be responsible for approving the annual budget for tourism <br /> promotion programs. <br /> (2) Advise the San Marcos Area Chamber of Commerce as to the <br /> hiring and firing of management level employees responsible <br /> for tourism promotion programs. <br /> (3) Develop guidelines regarding the process for allocation of hotel <br /> <br /> occupancy tax funds for the arts through the San Marcos Area <br /> Chamber of Commerce. <br /> f4} Have other duties and authority as described in contracts <br /> between the city and the San Marcos Area Chamber of <br /> Commerce for tourism promotion programs. <br /> SECTION 3. The initial appointees to the Arts Commission will determine their <br /> terms of office by drawing lots. <br /> SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance <br /> is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br /> provisions of this ordinance will continue in force if they can be given effect without the <br /> invalid portion. <br /> SECTION 5. All ordinances and resolution or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 6. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 7. This Ordinance will take effect 10 days after the date of its final <br /> passage, and the City Secretary will publish notice of its adoption in a newspaper of <br /> general circulation in the City. <br /> PASSED AND APPROVED on first reading AUGUST 241 1998 <br /> PASSED AND APPROVED on second reading SEPTEMBER 141 1998 <br /> PASSED, APPROVED AND ADOPTED OCTOBER 261 1998 <br /> &.~~~ <br /> Billy G.
