OF LAND CONTAINING 152.18 ACRES, MORE OR LESS, -~ cn¡; LOCATED ADJACENT TO THE 1100-1300 BLOCKS OF u.,i~ 5~ CLOVIS BARKER ROAD AND THE 1100-1200 BLOCKS OF U CIVIC CENTER LOOP; APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING FOR PUBLICATION AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two (2) public hearings, held on August] 0 1998 , and on August 24. 1998 ,to consider the proposed annexation by the City of 152.18 acres, more or less, located adjacent to the 1100 -1300 blocks of Clovis Barker Road and the 1100-1200 blocks of Civic Center Loop, Hays County, Texas, described by metes and bounds in the attached Exhibit A (the "Annexation Area"). 2. An on-site public hearing has not been requested in writing by more than 20 adults residing in the Annexation Area. 3. Notices of these public hearings were published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on July 24. 1998 and August 12, ]998 ,these dates being not more than 20 days nor less than 10 days prior to the respective hearings. 4. Prior to the publication of notices of these hearings, the City Council directed preparation of a service plan that provides for the extension of municipal services to the Annexation Area. 5. The proposed service plan was made available for inspection and explained to residents, if any, of the Annexation Area at the public hearings. 6. The Annexation Area is contiguous and adjacent to the current boundaries of the City. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Annexation Area is annexed to the City of San Marcos, Texas. SECTION 2. The Service Plan for the Annexation Area, a copy of which is attached hereto as Exhibit B and incorporated herein for all purposes, is approved. SECTION 3. The corporate limits of the City are extended to include the Annexation Area. SECTION 4. The Annexation Area is a part of the City of San Marcos, Texas, and residents in it are entitled to all the rights and privileges of all citizens of the City, and are bound by the acts, ordinances, resolutions and regulations of the City. SECTION 5. This Ordinance shall be in effect ten (10) days from and after its passage, and notice of its adoption shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
