<br /> ATTACHMENT SC <br /> SCOPE OF SERVICES AND RESPONSIBILITIES OF OWNER <br /> BASIC SERVICES: FNI shall render the following professional services in connection with the development of <br /> the Project: <br /> A. Meetwith City of San Marcos staff and attorneys to review the proposed application and obtain data: <br /> 1. Review the proposed approach to the hearing and outline of testimony. <br /> 2. Obtain available information from the City, including wastewater discharge, planned operation ofthe <br /> downstream rediversion of treated wastewater, and previous reports and studies. <br /> 3. Accompanied by City staff, visit the San Marcos River from the wastewater plant to the location of the <br /> proposed rediversion. <br /> B Contact engineers and biologists who have made previous studies for the City, including Paul Price, HDR, <br /> and Alan Plummer and Associates. Obtain information developed in previous studies. <br /> C. Develop a methodology to determine what fraction of the wastewater discharged from the San Marcos <br /> wastewater treatment plant originates from groundwater. <br /> D. Develop a methodology to determine the transportation time from the point of discharge to the point of <br /> diversion. <br /> E. Develop a methodology to determine the carriage losses from the point of discharge to the point of <br /> diversion. <br /> F. Develop a methodology to determine the rate at which water may be diverted based upon the volume and <br /> rate of the effluent discharged, the transport time of the effluent, and any carriage losses. <br /> G. Review the water availability model for the Guadalupe Basin previously developed by the Texas Water <br /> Commission and used in the analysis of water rights in recent years to determine the assumed level of return <br /> flow from San Marcos. <br /> H. Analyze the potential impact of the proposed diversion on downstream water rights and environmental uses. <br /> Propose conditions, if appropriate, to protect downstream water rights and environmental uses. <br /> I. Prepare a memorandum describing the above analysis and findings. Review the memorandum with City <br /> staff and attorneys. Attend hearings on the proposed application and provide expert testimony on these <br /> issues. <br /> J. Provide additional analysis and review if requested and authorized by City staff. <br /> RESPONSIBILITIES OF OWNER: OWNER shall perform the following in a timely manner so as not to delay <br /> the services of FNI: <br /> A. Designate in writing a person to act as OWNER's representative with respect to the services to be rendered <br /> under this AGREEMENT.
