PROCEDURAL PROVISIONS; PROVIDING FOR <br />iL~..... ~ ¡::'-. PENALTIES; AND DECLARING AN EMERGENCY. <br />:&?! am <br /> <br />RECITALS: <br /> <br />1. The City has suffered extensive flood damage from rainfall on October 17th, <br />18th and 19th, the cleanup from which has necessitated the use of large amounts of water <br />by many City water system customers. <br /> <br />2. The City Council wishes to afford residents relief from the increased bills for <br />water usage that result from extensive cleanup efforts. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. The water rates established under Section 86.231 of the San Marcos <br />City Code are amended for all addresses confirmed by the City as being damaged by the <br />recent flooding, to charge for the lesser of 1) the water usage for the addresses during the <br />previous month's billing period, and 2) the current month's water usage for the addresses, <br />for all billings scheduled for mailing on November 9, 1998, November 16, 1998, November <br />24, 1998 and December 1, 1998. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph ofthis ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed, for only the billings scheduled for mailing as <br />described above in Section 1. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 5. The importance of this Ordinance creates an emergency and an <br />imperative public necessity, and the provisions ofthe Charter requiring that ordinances be <br />presented at three separate meetings, and that ordinances do not take effect until ten (10) <br />days after the date of final passage are suspended, and this Ordinance will take effect <br />upon publication of notice of its adoption in a newspaper of general circulation in the City. <br /> <br />PASSED, APPROVED AND ADOPTED this 9TH day of NOVEMBER, 1998. <br /> <br />~~~~ <br />Billy G.
