<br /> S. Acceptance of Premises. Tenant acknowledges that it has fully inspected the Demised
<br /> Premises and Tenant hereby accepts the Demised Premises, and the buildings and improvements situated
<br /> thereon, as suitable for the purposes for which the Demised Premises are leased and intended, AS IS, in
<br /> there present condition. If finish out is to be provided Tenant, the finish out will be shown by a work
<br /> letter attached hereto.
<br /> 6. Use of Premises. The Demised Premises shall be used and occupied only for the
<br /> following purposes, and no other: Operation of a WIC program agency office.
<br /> Tenant will not occupy or use, nor permit any portion of the Demised Premises to be occupied or
<br /> used for any business or purpose which is unlawful in part or in whole or deemed to be disreputable in any
<br /> manner, or extra hazardous on account of fire, explosion or flooding, nor permit anything to be done
<br /> which will in any way increase the rate of fire insurance on the Shopping Center or contents. In the event
<br /> that by reason of acts of Tenant, there shall be any increase in the rate of insurance on the Shopping
<br /> Center or contents created by Tenant's acts or conduct of business, then, at Landlord's election Tenant will
<br /> and hereby agrees to pay such increase, or this Lease may be terminated by Landlord.
<br /> Tenant will maintain the Demised Premises in a clean and healthful condition and comply at its
<br /> expense, with all laws, ordinances, orders, rules and regulations (State, Federal, Municipal and other
<br /> agencies or bodies having any jurisdiction thereof) with reference to uses, conditions or occupancy of the
<br /> Demised Premises, including obtaining all necessary permits and licenses.
<br /> Tenant will conduct its business, and control its agents, employees and invitees in such a manner
<br /> as not to create any nuisance, inteñere with, annoy or disturb other tenants or Landlord in the
<br /> management of the Shopping Center.
<br /> Tenant acknowledges that, except as herein expressly provided, neither Landlord nor any agent
<br /> of Landlord has made any representation or warranty with respect to the Demised Premises, the Shopping
<br /> Center, and the improvements thereon or with respect to the suitability of either for the conduct of
<br /> Tenant's business, nor has Landlord agreed to undertake any modification, alteration or improvement to
<br /> the Demised Premises except as provided in this Lease. Landlord and Tenant expressly disclaim any ~
<br /> implied or. express warranty that the Demised Premises are suitable for Tenant's intended commercial
<br /> purpose.
<br /> 7.
<br /> Demised Premises continuously during the entire Term of this Lease and will 0 nt s.business a t(

<br /> operation of such business. Tenant sh open on regular business days (Sundays and national -
<br /> holidays exclude y enant) during and between the hours of 9:00 a.m. to 6:00 p.m., and will
<br /> 8. Maintenance bv Landlord. Landlord shall maintain only the roof, foundation,
<br /> underground or otheIWise concealed plumbing,* and the structural soundness of the exterior walls
<br /> (excluding all windows, window glass, plate glass and all doors) of the Demised Premises in good repair
<br /> and condition, except for reasonable wear and tear. Tenant shall give immediate written notice to
<br /> Landlord of the need for repairs before any liability of Landlord to make such repairs or corrections shall
<br /> arise. Landlord's liability hereunder shall be limited to the cost of such repairs or corrections, and Tenant
<br /> agrees to indemnify Landlord from any excess. Landlord reserves the right to place over, under or behind
<br /> the Dcmised Premises pipes, wires, lines and other facilities serving other areas of the Shopping Center.
<br /> Tenant will permit Landlord and Landlord's agents, employees or representatives to enter into
<br /> and upon any and all parts of the Demised Premises at all reasonable hours to inspect same or make such
<br /> repairs or alterations as Landlord seems necessary, and Tenant shall not be entitled to any abatement or
<br /> reduction of rent by reason thereof. Landlord shall be entitled to make such repairs and alterations of
<br /> common areas and grounds in the Shopping Center as Landlord deems necessary, and Tenant shall not be
<br /> entitled to any damages or abatement or reduction of rent by reason thereof even though such repairs or
<br /> alterations may affect temporarily Tenant's use of the Demised Premises.
<br /> 9. Maintenance bv Tenant. Tenant shall at its expense and risk maintain all other pans of J
<br /> the building and other improvements on the Demised Premises in good repair and condition, including
<br /> but not limited to repairs (including all necessary replacements) to the interior plumbing, windows,
<br /> window glass, plate glass, doors, ) UtllL! I! "", HtI ~. J! li,-ro;, fire protection sprinkler
<br /> system, and the interior of the Demised Premises in general. Tenant will provide and maintain vermin-
<br /> proof receptacles for Tenant's own use in the event refuse is temporarily stored outside of the Demised
<br /> Premises, and Tenant will be responsible for the removal of said refuse and will promptly and strictly
<br /> comply with all health, sanitary or other laws, regulations and ordinances pertaining to the depositing and
<br /> removal of such refuse from or about the Demised Premises. Such receptacle shall be solely in such areas,
<br /> if any, designated by Landlord. Tenant will not use the common areas or other area outside of the
<br /> Demised Premises to store pallets, cartons or other material or items. Tenant further agrees to be
