<br /> " <br /> ~ >-"'" 216 <br /> G- c:::8 <br /> -- ~~ <br /> ..... w...:à'. <br /> m c: <br /> -.,.J ," <br /> 'i ".,-' cJ? <br /> en- <br /> ò, ORDINANCE 1998----1li) <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING LOT 17 OF THE <br /> SOUTHEND ADDITION LOCATED IN THE 300 BLOCK OF <br /> RAILROAD STREET FROM "M" SINGLE-FAMILY, DUPLEX <br /> AND NEIGHBORHOOD BUSINESS DISTRICT TO "R-2" <br /> SINGLE-FAMILY RESIDENTIAL DISTRICT (MEDIUM <br /> DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br /> PROVIDING FOR PENALTIES. <br /> RECITALS: <br /> 1. On September 22, 1998, the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br /> Family, Duplex and Neighborhood Business District to "R-2" Single-Family Residential <br /> District (Medium Density) for Lot 17 of the Southend Addition in the 300 Block of Railroad <br /> Street. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on September 22, 1998 consider and vote to approve the request, and <br /> has recommended that the request be approved by the City Council of the City. <br /> 3. The City Council held a public hearing on the 23 day of <br /> November , 1998, regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, ofthe San Marcos City Code pertaining <br /> to zoning map amendments have been met. <br /> 5. The City Council hereby finds and determines that the adoption of the following <br /> ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br /> of the San Marcos City Code, is amended to rezone the following real property which is <br /> presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "R-2" <br /> Single-Family Residential District (Medium Density): <br /> Street address: 300 Block of Railroad Street. <br /> Legal description: Lot 17 of the South end Add ition. <br /> <br /> Deed or plat reference: Volume 55, pages 600-601, Hays County Deed Records. <br /> <br /> SECTION 2. Any person violating any provision of this ordinance commits a <br /> misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br /> City Code upon conviction. <br /> SECTION 3. After its original passage, this ordinance will be subject to <br /> reconsideration at the next regular City Council meeting. If this ordinance is not <br /> reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br /> in a newspaper of general circulation in the City. This ordinance will take effect upon <br /> publication of this notice. <br /> PASSED, APPROVED AND ADOPTED this 23rd day of November <br /> 1998, subject to reconsideration at the next regular City Council meeting scheduled for <br />
