The City's Fair Housing ordinance provisions are in need of updating to reassign the <br />oversight role of the Fair Housing Commission to the Human Development Commission, <br />to simplify terminology and procedures, arid to êldd persons with disabilities and "fê milial <br />status" as classes of persons protected against discrimination in hóusing. <br /> <br />2. The U.S. Department of Housing and Urban Development requires the City to <br />periodically update its fair housing regulations in order for the City to continue its eligibility <br />to receive federal Community Development Block Grant funding. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: <br /> <br />SECTION 1. Article 2, Fair Housing, Chapter 46 of the City Code is amended as follows <br />(underlining indicates added text and o"ierstrike indicates deleted text): <br /> <br />ARTICLE 2. FAIR HOUSING. <br /> <br />DIVISION 1. GENERALLY <br /> <br />Section 46.026. Definitions. <br /> <br />In this article: <br /> <br />Commission means the city human development fair housing commission. <br /> <br />Complainant means a person who files a complaint under section 46.052. <br /> <br />Conciliation means the attempted resolution of issues raised by a complainant or <br />by the investiQation of a complaint through informal neQotiations involvinQ the complainant. <br />the respondent. the fair housing officer and the commission. <br /> <br />DisabjJitv means (a) a physical or mental impairment that substantially limits one or <br />more of the major life activities of an individual (functions such as. but not limited to. caring <br />for oneself, performinQ manual tasks, walking. seeing. hearing. speakinQ. breathing. <br />learninQ and working) (b) a record of such an impairment: or (c) þeing regard~having <br />such an impairment. This does not include the current illegal use of or addiction to a <br />controlled substance as defined in the federal Controlled Substance Act. as amended. and <br />does not apply to an individual because of an individual's sexual orientation or because that <br />individual is a transvestite. <br /> <br />Discriminatory housing practice? means an act that is unla\vful under sections 46.(;)76, <br />46.078 and 46.079 prohibited by this article. <br /> <br />Dwelling means any building, structure or part of a building or structure that is portion <br />thereof occypied as. or designated designed or-and-intended for occupancy as a residence <br /> <br /> <br />1 <br />
